Abstract
This thesis investigates interactions between New Technologies (NTs) and Intellectual Property Rights (IPRs, mainly patents and copyrights). To what extend these interactions lead to à redefinition the status and use of IPRs? What part do IPRs play in the crea tion and innovation process? The context that took place in the beginning of the 1990's underlines some issues inherent to the IPRs system, while creating new distortions, as shown by the software industry in the United States, which is in fast growth and the field of many legal changes. This thesis aims to analyze some aspects of interactions between IPRs and NTs, related to the issues that go along with the new order. We study practical aspects of IPRs implementation in the ITs. We try to characterize the new order from three angles, each one being a chapter.
